  • What is workers’ compensation?

    Workers’ compensation is an insurance scheme that provides support for workers with a work-related injury or illness. It also covers people injured at work even if your employer doesn’t have insurance.

  • Am I entitled to workers’ compensation?

    If you have suffered a physical or mental injury at work you are entitled to claim WorkCover, this is regardless if you are a casual, full time or part time employee.

  • What injuries are covered by WorkCover?

    Your injury or illness must be work-related. Injuries typically covered include:

    • Distinct injuries suffered at work or injuries which may have occurred over time.
    • An aggravation, deterioration, acceleration and exacerbation of a pre-existing injury or disease
    • Psychological and mental health injuries
    • Hearing loss

  • What do I need to do if I’m injured at work and want to claim workers’ compensation?

    Any work-related injury or illness should be reported to your employer within 30 days and you should submit your Workcover Claim Form within 30 days as well.

    If it has been more than 30 days since becoming aware of your work-related injury or illness, we recommend that you contact us immediately for some free legal advice.

  • How do I lodge a claim?

    You must lodge a Work Injury Claim Form on your employer to commence the claims process. This should be done as soon as practicable after you have suffered your injury. The insurer must provide a written response either accepting or rejecting your claim within 28 days after it receives the Work Injury Claim form.

  • Will I receive my full pay if I am unable to work?

    The following table sets out the weekly payments of compensation you may be entitled to if your claim is accepted:

    Current work capacity 95% of your weekly earnings less what you are currently earning
    14-130 weeks No current work capacity 80% of your weekly earnings up to $2,590

    After 130 weeks No current work capacity indefinitely 80% of your weekly earnings up to $2,590
    After 130 weeks – worker has returned for at least 15 hours per week and has current weekly earnings of at least $199 Current work capacity – is working at full capacity indefinitely 80% of your weekly earnings less what you are currently earning
  • What about superannuation payments?

    If you are injured on or after 5 April 2010, you will receive superannuation payments after 52 weeks of Workcover weekly payments.

  • How long does a claim normally take?

    Your claim once lodged must be accepted or rejected within 28 days. If your claim includes a mental health injury, you may be entitled to some payments and treatment regardless of the decision.

  • What do I do if my claim is denied?

    If your claim is denied, you have 60 days within which to dispute Insurer’s decision. In these circumstances contact us for free legal advice.

  • What should I do if I am contacted by an investigator?

    If you are contacted by an insurance investigator, you are not under any obligation to speak to the investigator or provide a statement. We suggest you contact our office before providing any statement.

  • Do I need a lawyer now?
